Any quotation issued by EMPS is valid for 7 (seven) days, unless otherwise stated.
Acceptance of a quotation constitutes acceptance of these Terms & Conditions.
No work will commence until the required deposit has been received.
A non-refundable deposit of 80% is required upon acceptance of the quotation.
The remaining balance is due immediately upon presentation of the final invoice.
EMPS reserves the right to:
Suspend or withhold services for non-payment
Charge interest on overdue amounts at the maximum rate permitted by law
Work will be carried out strictly in accordance with the accepted quotation.
Any additional work requested will:
Be quoted separately, and
Only proceed upon written approval
All goods remain the property of EMPS until paid in full.
Risk in goods passes to the client upon:
Delivery, or
Installation on site
The client agrees to:
Provide safe, unobstructed access to the site
Ensure the site is ready for installation
Comply with all safety requirements
EMPS reserves the right to:
Charge additional fees for delays caused by site conditions
Postpone work if conditions are unsafe
All products are subject to availability.
EMPS reserves the right to substitute products with similar or equivalent specifications without prior notice.
EMPS provides a workmanship warranty limited to defects arising directly from installation.
Manufacturer warranties apply to products where applicable.
Warranty excludes:
Labour and travel costs
Damage caused by misuse, negligence, power surges, or external factors
Any work carried out by third parties without EMPS written consent will void all warranties.
To the fullest extent permitted by law, EMPS shall not be liable for:
Indirect or consequential damages
Loss of income or business interruption
Damage caused by:
Power surges
Municipal supply issues
Third-party interference
In accordance with the Consumer Protection Act:
Cancellations must be made in writing
EMPS reserves the right to charge a reasonable cancellation fee based on:
Work completed
Materials ordered
Administrative costs
Deposits may be retained to cover these costs.
EMPS shall not be liable for delays caused by events beyond its control, including but not limited to:
Load shedding
Supplier shortages
Weather conditions
Strikes or civil unrest
All work will be carried out in accordance with applicable South African regulations and standards.
Clients are responsible for obtaining any required approvals unless otherwise agreed.
EMPS processes personal information in accordance with the Protection of Personal Information Act (POPIA).
By engaging EMPS, you consent to the processing of your personal information for service delivery purposes.
These Terms & Conditions are governed by the laws of South Africa.
Any disputes shall be subject to the jurisdiction of the courts of Gauteng.
All quotations and documentation are subject to E&OE (Errors and Omissions Excepted).
These Terms & Conditions constitute the entire agreement between the parties.
No amendment shall be valid unless in writing and signed by both parties.
